Information to be provided when obtaining personal data from the data subject – client.

Information under GDPR

  4. Purpose of processing: Provision of financial intermediation pursuant to Act No. 186/2009 Coll. on Financial Intermediation and Financial Advisory Services and on amendments to certain laws.

  5. Recipients or categories of recipients of personal data:

    • Tied financial agents of the controller.
    • Suppliers and administrators of software solutions (Socik s.r.o).

    The controller does not intend to transfer personal data to a third country or an international organization.

  6. Period of personal data storage: In accordance with Section 36(2) of Act No. 186/2009 Coll. on Financial Intermediation and Financial Advisory Services and on amendments to certain laws – 10 years from the provision of financial intermediation.

  7. Obligation to provide data: The controller informed the data subject that the provision of personal data is a legal requirement as well as a requirement necessary for the conclusion of a contract for the provision of a financial service, and that for this purpose the data subject is obliged to provide personal data. Failure to do so may result in the impossibility of providing financial intermediation.

  8. The controller also provides the data subject with the following information about their rights:

    • Right to rectification: The data subject has the right to have the controller, without undue delay, correct inaccurate personal data concerning them. Taking into account the purposes of processing, the data subject has the right to have incomplete personal data completed, including by means of a supplementary statement.

    • Right of access: The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning them are being processed, and, where that is the case, access to the personal data and additional detailed information on the processing as set out by law.

    • Right to erasure (“right to be forgotten”): The data subject also has the right to obtain from the controller the erasure of personal data concerning them without undue delay, and the controller is obliged to erase personal data without undue delay where the conditions set out by law and by Act No. 186/2009 Coll. are fulfilled.

    • Right to restriction of processing: The data subject has the right to obtain restriction of processing by the controller in cases defined by law.

    • Right to object to processing: The data subject has the right to object, on grounds relating to their particular situation, at any time to the processing of personal data concerning them, where such processing is based on a lawful ground defined by law.

    • Right to data portability: The data subject has the right to receive the personal data concerning them, which they have provided to the controller, in a structured, commonly used, and machine-readable format and has the right to transmit those data to another controller, subject to the conditions set by law.

    • Right to lodge a complaint: with the Office for Personal Data Protection of the Slovak Republic.

    • Right to compensation: including non-material damage caused by a breach of personal data protection.

  9. The controller informs the data subject that no automated decision-making, including profiling, will be carried out using personal data.

  10. The controller undertakes to provide the data subject with information about any other purpose and other relevant information before any further processing of personal data, if the controller intends to further process personal data for a purpose other than that for which they were collected.
